These Terms govern the purchase of tickets and related products/services made via ticketsfest.eu and authorized partners. By placing an order, you (“Customer”, “you”) accept these Terms as well as any Organizer Terms applicable to the specific event.
1) General Rules
- TicketsFest.EU operates a ticket distribution platform. For each event, the Organizator (the event owner/producer/venue or their agent) is identified on the event page. Unless stated otherwise, the Organizer is a business entity and the event is part of its regular commercial activity.
- By purchasing a ticket, you enter into: (a) a ticket sale agreement with TicketsFest.EU (distribution/fulfilment), and (b) an event attendance agreement with the Organizer (access and participation).
- If there is a conflict between these Terms and the Organizer Terms, the latter govern attendance-related matters (admission rules, age limits, seating plans, program changes, etc.).
- You can read and must accept these Terms and the Organizer Terms before completing your order.
2) Ordering & Contract Formation
- Tickets are sold through ticketsfest.eu and authorized offline or online partners.
- To purchase: select the event, ticket type/category, and where applicable numbered seats or a quantity of general-admission tickets; provide required details; and choose payment and delivery options.
- Clicking “Confirm and pay” constitutes an order with an obligation to pay and creates a binding contract under distance-selling rules.
- You must provide accurate information. Incorrect data (e.g., amount, reservation number, payment reference, payer details) may prevent allocation of funds and result in cancellation.
- Automated tools/bots for purchasing are prohibited. We may cancel tickets obtained through prohibited means.
- TicketsFest.EU acts as the intermediary between Organizer and Customer regarding the acquisition of tickets; we are responsible for delivering valid tickets. The Organizer is responsible for granting admission and staging the event.
3) Tickets
- A ticket is a right of entry for one person to the specific event indicated on it. Tickets may be named (personalized) or bearer tickets; if named, only the named person may be admitted. The Organizer decides whether and how name changes are possible and any related fees.
- Tickets are validated at entry. Re-use is not possible. Copying, scanning, reproducing, or altering tickets is strictly prohibited and invalidates the ticket.
- Keep your ticket secure. TicketsFest.EU is not liable for lost, stolen, or damaged tickets or for consequences of sharing ticket data with third parties.
- Duplicates/reissues are only possible if permitted by the Organizer and may incur a fee.
- Verify your ticket upon receipt. If it does not match your order, notify TicketsFest.EU without delay.
- Seating/placement: the ticket grants the right to the seat/zone specified. For valid technical or production reasons, TicketsFest.EU and/or the Organizer may relocate you to comparable seats/areas before or during the event.
- Purchase limits: To prevent unfair purchasing, we may cap the number of tickets per person/account/payment instrument. Exceeding limits (including via multiple accounts) may lead to cancellation of excess tickets.
- Resale: Buying tickets with the intention of reselling at a profit or reselling at a profit may breach applicable law and/or Organizer Terms. Organizers may prohibit resale or transfer.
- Tickets must not be bundled with travel/hospitality or other goods/services to form a package unless TicketsFest.EU or the Organizer gives prior written consent.
4) Prices, Fees & Availability
- Ticket prices and price categories are set by the Organizer. Maps and seat plans on the Platform are indicative; for visibility, obstructions, or hall specifics, consult the Organizer.
- Inventory may increase or decrease during the sales period (additional allocations or holds).
- Prices may change over time. If your earlier reservation is cancelled (e.g., late payment or failed verification), we are not liable if tickets are later only available at different prices or sold out.
- Service fees and charges: TicketsFest.EU may apply service/processing fees to cover platform and distribution costs. Any mandatory Organizer fees may also apply. All payable amounts are displayed before you confirm purchase.
5) Payment
- Available payment methods may include traditional bank transfer, online transfer, payment cards, BLIK, digital wallets, deferred or installment payments—subject to Organizer availability and payment provider terms.
- For online card/transfer payments, after clicking “Confirm and pay” you will be redirected to the relevant payment provider’s page. The provider is responsible for the execution and security of the transaction per its own terms. Missing the provider’s time limit may cancel your reservation.
- For traditional bank transfers, follow the exact instructions in the reservation confirmation (amount, title/reference, deadline). If funds are not received within the stated time, the reservation may be cancelled and tickets returned to sale. Funds received after the deadline will be refunded.
6) Delivery & Collection
- E-ticket (“home ticket”): after successful payment, tickets are delivered as a link/attachment for download or display on a mobile device. TicketsFest.EU is not responsible for consequences of providing an incorrect email address or for any unauthorized duplication by the Customer or third parties.
- Courier/postal delivery (if offered): dispatch order follows event date priority. Delivery times depend on region and accurate address data. Costs and timelines are shown during checkout.
- Risk of loss for physical tickets passes upon handover to the carrier at the address you provided.
7) Admission & Participation
- The Organizer and the venue owner/manager may deny admission for breach of event/venue rules and may conduct security checks for safety.
- Latecomers may be admitted only at appropriate breaks and admission cannot be guaranteed.
- Unauthorized use of recording/photographic equipment is prohibited. Laser pointers, certain items, pets (except assistance dogs), and outside food/drink may be restricted—always check venue and Organizer rules.
- Prolonged exposure to loud sound may cause hearing damage. Special effects (audio-visual, lighting, pyrotechnics) may be used and can pose health considerations for some individuals.
- Customers must comply with current public health guidelines and any Organizer instructions.
8) Right of Withdrawal & Refunds
- Consumer withdrawal for tickets: Under Article 38(12) of the Polish Consumer Rights Act (implementing EU law), there is no right of withdrawal for ticket purchases concluded at a distance.
- Products (non-ticket items): If we sell physical/digital products other than tickets, the 14-day consumer withdrawal right may apply as stated during purchase. Refunds are processed promptly and no later than 14 days after receiving the withdrawal notice; TicketsFest.EU may withhold refund until receiving the product or proof of return.
- Event cancelled: If the event is cancelled, TicketsFest.EU will refund the ticket price and mandatory fees paid, within 14 days of cancellation after receiving the corresponding funds from the Organizer. Refunds will be made to the original payment method where possible. Tickets bought at retail partners should be returned at the point of purchase.
- Date/venue change: If the event date or venue changes, the Organizer (via TicketsFest.EU) may offer alternative tickets of equivalent value (subject to availability). At your request, we will process a refund of the ticket price and mandatory fees within 14 days of your request, subject to payment provider rules.
- Other cases: Exchanges or refunds not covered above are not available unless the Organizer Terms state otherwise.
9) Complaints
- You may submit purchase-related complaints using the contact channels indicated on ticketsfest.eu. We will respond without undue delay and no later than 14 days after receipt.
- TicketsFest.EU is not the Organizer. For refunds, rescheduling, and admission matters, section 8 and the Organizer Terms apply.
- Consumers may use alternative dispute resolution (ADR) and the EU ODR platform: https://webgate.ec.europa.eu/odr/.
10) Liability
- TicketsFest.EU is responsible only for tickets purchased via ticketsfest.eu or our authorized partners. Tickets bought from unofficial sources may be invalid.
- The Organizer is solely responsible for staging the event, its program, and for admitting ticket holders.
- Any travel, accommodation, or ancillary services you arrange are at your own risk.
11) Governing Law
- These Terms and ticket purchases are governed by the laws of the Republic of Poland.
- For EU consumers with habitual residence in another Member State, the choice of Polish law does not deprive you of protection afforded by mandatory provisions of your home country (Article 6, Rome I).
12) Personal Data
- Personal data provided by Customers is processed in accordance with applicable law and our Polityka prywatności available on ticketsfest.eu.
- Where necessary to perform the Transaction and facilitate the event, relevant Customer data may be shared with the Organizer.
- Using Customer contact tools within the Platform for external commercial promotion is prohibited.
- For security and anti-spam reasons, TicketsFest.EU may filter or block messages sent via Platform tools; where automated handling is not possible, messages may be forwarded to the Organizer for response.
13) Changes & Termination
- You may terminate your account with immediate effect by deleting it; termination does not affect obligations arising from completed purchases.
- We may amend these Terms by publishing the updated version or otherwise making it available to you. Changes take effect 14 days after publication (or on a later date indicated). Purchases made before the effective date remain governed by the previous version.
